Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in its entirety. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
9. Indemnification

YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION. The arbitrator shall have no authority to consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the completion of arbitration. Nothing in this section shall prevent either party from bringing an action in small claims court for disputes within that court's applicable jurisdictional limits.
